Terms and Conditions

Welcome to Crypto Whailes. By accessing or using our website and services (the “Services”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be legally permitted to use the Services in your jurisdiction and at least 18 years old. You are solely responsible for your account, your actions, your trades, and for keeping your login and API keys secure. All activity under your account is your responsibility, whether authorized or not.

2. Subscriptions & Access

Some features require a paid subscription. Prices, plans, and limits are displayed in the app and may change at any time. All sales are final and non-refundable. We may suspend or revoke access for any misuse or violation of these Terms.

2.1 Hobby / Non‑Commercial Nature

The Services are provided on a best‑effort basis by an individual operator. There are no service level commitments, uptime guarantees, or ongoing support obligations. You acknowledge that features can change rapidly and the Service may be paused or shut down at the operator’s discretion.

3. Trading Risk Disclaimer

Trading digital assets is inherently risky and may result in complete loss of funds. Crypto Whailes does not provide investment, financial, tax, or legal advice. All trades and strategies are your own decision and at your sole risk. Past results do not guarantee future outcomes.

3.1 Demo vs Live Trading

Any demo, sandbox, or paper-trading mode is a simulated environment that may not reflect live market conditions. Trade execution, slippage, latency, and order fills can differ significantly between demo and live accounts. You should not assume that positive performance in a demo environment will translate to identical results in live trading. Crypto Whailes is not responsible for differences in outcomes when you move from demo testing to real capital deployment.

4. API Keys & Security

If you connect exchange API keys, you accept full responsibility for securing them. We strongly recommend exchange-side security (e.g., IP whitelisting, withdrawal restrictions). Crypto Whailes is not responsible for any loss, theft, or misuse of your keys.

5. Acceptable Use

You may not misuse the Services, attempt unauthorized access, reverse engineer, overload, or use the Services in violation of law or exchange rules. Accounts may be suspended or terminated immediately for abuse.

6. Referrals & Payments

We may provide referral programs at our discretion. Participation does not guarantee payment. Referral amounts, rules, and eligibility may be changed or withdrawn at any time. We reserve the right to withhold payments, restrict users, or permanently ban accounts if suspicious, abusive, or fraudulent activity is suspected. We are under no obligation to pay referral rewards. All associated fees and costs are the sole responsibility of the user. We may receive commissions, payouts, or other compensation from third parties when you sign up through referral links, affiliate links, or when you activate services promoted via Crypto Whailes. Those payments do not change your pricing or obligations, and you agree that Crypto Whailes makes no additional promises or warranties regarding the referred service beyond what the third party provides.

6.1 Leaderboard Participation

Leaderboard contests and rewards are offered at our sole discretion. We reserve the right to refuse, suspend, or ban any participant for any reason, at any time, with or without notice. We can change or add eligibility requirements, scoring mechanics, payout criteria, or any other leaderboard rule in real time, including retroactive updates. Payouts, rewards, benefits, or any leaderboard-linked incentive may be restricted, delayed, reduced, or withdrawn when we suspect abuse, you violate these Terms, or whenever we determine it is necessary to protect the leaderboard or the platform. Participation implies you accept that these decisions are final, non-contestable, and not a promise of future opportunity.

7. Intellectual Property

The Services, content, software, and UI are owned by us or our licensors and protected by law. You are granted a limited, non-transferable license to use the Services. No other rights are granted.

8. Disclaimers

The Services are provided “as is” and “as available” with no warranties of any kind. We do not guarantee uptime, accuracy, or suitability for any purpose. You assume all risk in using the Services.

9. Limitation of Liability

To the fullest extent permitted by law, Crypto Whailes is not liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to trading losses, data loss, or loss of profits. Your only remedy is to stop using the Services.

10. Data & Backtest Accuracy

Data, indicators, and backtests are provided for informational purposes only and are not guaranteed to be accurate, complete, reliable, or suitable for your trading goals. Backtesting results may not perfectly match real execution—even identical strategies can behave differently once orders hit exchanges, especially once network delays, slippage, or exchange limitations are factored in. Any inaccuracies in data, market coverage, or historical information are your own risk. We do not assume any responsibility for decisions you make based on data, backtests, or charts on our platform. We do not take on risk for price feeds, indicator outputs, or historical data being outdated, incorrectly labeled, missing, or otherwise inaccurate. If you need perfect accuracy, rely on an exchange’s official data feed or a dedicated paid provider instead of Crypto Whailes.

11. Attribution & Display-only Use

Any charts, indicators, alerts, or market information we surface may include third-party data. Unless explicitly permitted, that data is licensed for your display-only, internal, or personal use. Repackaging, reselling, sublicensing, constructing derivative products, or otherwise offering our data or output as a standalone product is prohibited without prior written permission.

When you publish, share, or embed any Crypto Whailes charts or visualizations outside our platform, you must clearly attribute Crypto Whailes (e.g., “Charts by Crypto Whailes” or similar). If we provide a snapshot/export with attribution baked in, do not remove or obscure that attribution.

12. Please Notify Us First

Before initiating any dispute, claim, or litigation against Crypto Whailes, you must send us written notice describing the alleged breach or issue with sufficient detail for us to investigate. Once we receive that notice, we will have 90 days to investigate, respond, and, if possible, cure the issue. You agree that you will not file a lawsuit, arbitration, or other formal proceeding until the 90-day notice period has expired, unless Crypto Whailes fails to cure the issue within that period or unreasonably refuses to engage on the matter.

13. User-Generated Content & Publication

You alone are responsible for any strategies, alerts, scripts, screenshots, images, or other content you publish, upload, or share through the Services. By publishing or sharing content, you represent and warrant that you either own all rights to that content or have obtained every permission needed to post and distribute it. That responsibility stays with you regardless of whether the content is public, shared with friends, or embedded elsewhere. You also accept the risk that anything you publish may be reused, reposted, or reshared by others. We do not police every upload, and we make no promises that published content meets any accuracy or quality standard. If your content is inappropriate, infringing, or causes harm, you alone remain fully liable—Crypto Whailes may take down such content, but we are not responsible for what others do with it before or after any takedown. We explicitly reserve the right to suspend, delete, or revoke any script, alert, image, or other contribution you make if we believe it violates applicable law, is inappropriate, or is being weaponized against the platform or other users.

14. Indemnification

You agree to indemnify, defend, and hold harmless Crypto Whailes, its officers, contractors, and affiliates from any third-party claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising out of or related to (a) your use of the Services, (b) any content you upload, publish, or share, (c) your automation or trading activity, or (d) violation of these Terms.

15. Access & API Licensing

Any API, webhook, or automation access we provide is licensed solely for your internal display, automation testing, or personal use. You may not repurpose the access to provide services to third parties, or to scrape or redistribute data, without our explicit written approval. Misuse, abuse, or sustained traffic that threatens stability may result in throttling, disabling, or revoking access at our discretion, even if you have an active paid subscription.

16. Webhooks & Automation Delivery

Webhooks, alerts, notifications, and automated actions are provided on a best-effort basis without guarantees of delivery, timing, or completeness. They may fail silently if our servers are down, your network is unreachable, the target endpoint is offline, or external dependencies (like exchanges or third-party APIs) are experiencing issues. You accept the risk that webhooks may fail, arrive late, or be delivered out of order, and Crypto Whailes disclaims any liability for resulting losses or missed opportunities. It is your responsibility to monitor your automation, implement redundancy, and double-check outcomes before placing live trades.

17. Changes & Content Control

We may update these Terms at any time, and—given the hobby nature of the project—changes may occur more frequently than a commercial service. Changes take effect immediately upon posting unless otherwise stated. Your continued use after updates are posted constitutes acceptance of the updated Terms.

We may modify, limit, suspend, or discontinue any feature, content, or service we provide at our sole discretion, whether it is paid, unpaid, or provided free of charge. You understand that access to specific data, automations, or materials may be restricted or removed at any time without notice and that we are not obligated to preserve any behavior, personalization, or configuration you save. We may add new exchanges or remove existing exchanges at any time without notice.

18. Security Incident Notification

If we become aware of a security incident that may affect your personal data or API keys, we will notify you via the support channels listed below (Telegram message to @dewaldhamman or email to cryptowhailes@gmail.com) and update any relevant status or outage page.

19. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved exclusively in South African courts.
